Spanish to English Law/Patents Law (general) Supreme Court ruling
This term appears in the Supreme Court's ruling in an appeal for cassation against a sentence imposed on cocaine smugglers in Spain. Their argument is that "los hechos probados no pueden encuadrarse en un delito contra la salud publica al no contener el elemento subjetivo del injusto y por no existir prueba suficiente de la concurrencia de los elementos del tipo". I assume that "por no existir prueba suficiente pde la concurrencia de los elementos del tipo" means that there is insufficient proof of the facts, but can anybody explain what "elemento subjetivo del injusto" means please? I simply can't find an English translation or even a definition of this. Thank you so much!

I stay away... I stay away from legal doctrine and give it a simple and sweet translation, which I do quite often and in fact I just delivered some this AM. For me, "subjective elements of the crime" has always covered it well. The same Spanish phrase is used in Mexico and that is what I use for the US.

Such as committing it in a knowing fashion, etc. "con dolo", which may be presumed from circumstances.

But I use USA English.
