grandfathered agreement

Iophendylate came to be used in Australia under what is termed a "grandfathered" agreement, i.e., it is being used in three or more other countries, so it was unlicensed. It was imported into Australia under the Pantopaque brand name between 1974 and 1978, but was approved for experimental use only, licensed on a restricted basis to four hospitals. The importer of Pantopaque was licensed to import 150 units; in contravention of the import permit, 13,500 units were
imported into Australia.

So a grandfathered agreement honors old provisions that would otherwise not be valid, but instead are valid since it was signed before a certain date. HTH.

grandfathered: something that may currently be prohibited by law, regulation,etc., but is allowed to currently continue because it was established PRIOR TO being prohibited.

accord exclusif

j'ai d'abord cherché la signification de "grandfathered" et ai trouvé dans le dico anglais français dont tu trouveras l'adresse en 1ere référence le terme "exclu" dans le domaine des assurances, par exemple.
En cherchant les termes "accord exclusif", j'ai trouvé notamment le lien repris en 2e position, qui a mon sens reprend bien l'idée d'un accord entre plusieurs puissances pour intégrer un marché et procéder à un style d'importation parallèle (ce qui semble être le cas dans ton document).
En espérant que cela t'aidera...

A "grandfathered" agreement is one to which particular legislation does
not apply because the agreement met certain conditions at the time
the legislation was passed. In GST terms, a supply is said to be
"grandfathered" if the supply is GST free because of the operation of
the transitional GST provisions. Generally, these transitional provisions
apply to a supply made under an agreement that was entered into prior
to 2 December 1998 (or in some cases 8 July 1999) and that does not
provide an opportunity for the supplier to take into account the
imposition of GST in reviewing the consideration. Supplies made under
such an agreement are treated as GST-free prior to 1 July 2005, or until
a review opportunity arises.
