Translation - English Dear Sirs,
My son has been arrested by the Police and I am very worried because, in my opinion, he has been unlawfully deprived of his freedom.
According with the statistics that I have consulted, this seems to be a problem that occurs from time to time in all the jurisdictions in the United Kingdom.
I am under the impression that the simple event (fact) of stopping and arresting a person on the street, without a legal reason that justifies it, can on its own be considered an unjust arrest, which means that there is no need to put someone in prison - or to lock him in a Police Station’s cell - to qualify (be considered) as an unlawful deprivation of freedom. And that is what happened to my son.
I know fair well that, in general, we can trust the Police in our country, but it would be alarming if they had such wide powers as to allow them to arrest a person without complying with the requirements of the law.
Although I don’t think you can put a price on freedom, I would like to know how the compensation is being calculated in an event when someone has been unlawfully arrested, particularly if it has been for a prolonged period of time.
I would also like to know which one would be the consequences in the event of having a legitimate (valid) reason to arrest a person and take him/her to the Police Station, but his/her arrest was prolonged more than what it was absolutely necessary.
I beg of you as well that you advice me regarding the proceeding for my son to follow, who has been deprived of one of his fundamental rights, for him to claim a compensation.
Thanking them in advance for your answer, kind regards,
Carolina Gomez Paez
