If you disagree with the results of the evaluation conducted by the LEA, you have the right to ask for and obtain an independent educational evaluation (IEE) for your child from a person qualified to conduct the evaluation at public expense. You are entitled to only one independent educational evaluation at public expense each time the LEA conducts an evaluation with which you disagree. The LEA must respond to your request for an independent educational evaluation and provide you information upon request about where to obtain an independent educational evaluation. If the LEA disagrees that an independent evaluation is necessary, the LEA must request a due process hearing to prove that its evaluation was appropriate. If the LEA prevails, you still have the right to an independent evaluation but not at public expense. The IEP team must consider the results and recommendations of independent evaluations. LEA evaluation procedures allow in-class observation of students. If the LEA observes your child in his or her classroom during an evaluation or if the LEA would have been allowed to observe your child, an individual conducting an independent educational evaluation must also be allowed to observe your child in the classroom. If the LEA proposes a new school setting for your child and an independent educational evaluation is being conducted, the independent evaluator must be allowed to first observe the proposed new setting (Title 34 of the Code of Federal Regulations section 300.502; Education Code section 56329(b) and (c)).

Jeśli nie zgadzają się Państwo z wynikami oceny przeprowadzonej przez LEA, mają Państwo prawo poprosić o przeprowadzenie niezależnej oceny dziecka pod kątem potrzeby nauczania specjalnego (Independent Educational Evaluation, IEE), opłacanej ze środków publicznych, przez osobę do tego uprawnioną. Przysługuje Państwu prawo tylko do jednej niezależnej oceny dziecka pod kątem potrzeby nauczania specjalnego opłacanej ze środków publicznych, jeśli nie zgadają się Państwo z wynikiem oceny przeprowadzonej przez LEA. LEA musi odpowiedzieć na Państwa wniosek o niezależną ocenę dziecka pod kątem potrzeby nauczania specjalnego i na żądanie dostarczyć Państwu informacji o tym, gdzie można taką ocenę uzyskać. Jeżeli LEA nie zgadza się, że konieczna jest niezależna ocena, LEA musi zwrócić się o zwołanie spotkania wyjaśniającego, aby wykazać, że ocena przeprowadzona przez LEA jest prawidłowa. Jeśli w toku spotkania orzeknie się, że ocena LEA jest prawidłowa, nadal przysługuje Państwu prawo przeprowadzenia niezależnej oceny dziecka pod kątem potrzeby nauczania specjalnego, ale wówczas nie zostanie ona opłacona ze środków publicznych. Zespół IEP musi rozważyć wyniki i zalecenia niezależnych ocen. Procedury oceny LEA umożliwiają obserwację uczniów w klasie. Jeśli LEA obserwuje Państwa dziecko w swojej klasie podczas oceny lub gdyby LEA mogła obserwować Państwa dziecko, osoba prowadząca niezależną ocenę pod kątem nauczania specjalnego musi również mieć możliwość obserwowania dziecka w klasie. Jeśli LEA zaproponuje zmianę placówki dla Państwa dziecka i przeprowadzona zostanie niezależna ocena dziecka pod kątem potrzeby nauczania specjalnego, niezależny oceniający musi mieć najpierw możliwość obserwacji nowej placówki (Tytuł 34 Kodeksu Przepisów Federalnych, sekcja 300.502; Kodeks Edukacji sekcja 56329 (b) i (c)).
