U slučaju da se odlukom nadležnog organa Investitoru ne izda dozvola za izgradnu proizvodnog objekta ili izda dozvola za izgradnju objekta manje priključne snage od snage čije se priključenje dozvoljava ovim ugovorom, Investitor nema pravo na povraćaj novčanog iznosa koji je platio po ovom ugovoru na ime naknade za priključenje.
U slučaju da se odlukom nadležnog organa Investitoru izda dozvola za izgradnju objekta manje priključne snage od snage ugovorene ovim ugovorom, danom izdavanja takve dozvole oslobađa se prenosni kapacitet za razliku između ugovorene priključne snage i snage prizvodnog objekta čije je izgradnja odobrena odlukom nadležnog organa, te u tom trenutku Investitoru prestaje pravo na taj prenosni kapacitet bez obzira što je izvršio plaćanje naknade za priključenje i za tu razliku.

: The capacity charge is payed ... it is related to "Обрачунска снага" (which expressed in kW, not in money) but it's not the same // the price of a car is NOT the car.
