Hi Lara, presuming XXX at the beginning of the phrase is the same party as XXX at the end? And XXX is also the opposite party to the Borrower? I would say "BY", like Adrian
Actually looking at it your sentence I would probably phrase it something like " ... XXX has the power to request full or part repayment of the loan in the event/if the Borrower should have the necessary financial availability/funds and liquidity as determined and confirmed by XXX. It does also depend a little on what comes before this part of the sentence at the beginning in place of "....."

My Italian isn' t too ablative-absolute, but I thought the plural form of the adjective and participles suggest they both agree with the 2 preceding nouns and the phrase parses another way.
