GARNER'S DICTIONARY OF LEGAL USAGE:

ALEATORY; FORTUITOUS ; STOCHASTIC

These words have similar but distinct meanings. The first two are especially close, meaning “depending wholly on chance.” Aleatory derives from the Latin word for the game of dice: alea jacta est (= the die is cast). Fortuitous, meanwhile, carries the suggestion of an accident, usually but not always a happy one. (See fortuitous.) As it happens, aleatory usually refers to present descriptions or future events that depend on uncertain contingencies—e.g.:

• “The better rule, this court feels, is to respect the aleatory nature of the settlement process and to hold both the plaintiff and settling defendant to their gamble.”Doyle v. U.S., 441 F.Supp. 701, 711 n.5 (D.S.C. 1977).

• “The 2001 consent judgment in this case is an ALEATORY CONTRACT, which simply means it depended upon the uncertain act, i.e., the future purchase of the property by one of the heirs.”Peeler v. Dural, 958 So.2d 31, 35 (La. Ct. App. 2007).

Fortuitous, meaning “accidental, occurring by chance,” typically refers to past events <how fortuitous that the snowstorm shut down the city on the very day my cousin wanted me to stay home from work>. Stochastic, the most rarefied of these words, means “random”; it is fairly common in the writing of economic analysts and statisticians. See fortuitous. Cf. adventitious.
