El document de voluntats anticipades suposa una forma de continuar exercint el dret a ser respectat o respectada amb els propis valors.
El fonament del document de voluntats anticipades es troba en el respecte i la promoció de l'autonomia del pacient; autonomia que, mitjançant aquest document, es perllonga quan aquest no pot decidir per ell mateix.
Es tracta d'una forma de continuar exercint el dret a ser respectat o respectada amb els propis valors, assegurant que aquest respecte es mantindrà quan es presenti una situació de més vulnerabilitat.
El document de voluntats anticipades pot presentar diverses formes: pot ser el recull d'una sèrie d'instruccions a tenir en compte (és l'anomenat testament vital) o pot significar el nomenament d'un representant, o les dues coses a la vegada, opció que sembla la més aconsellable.
Per ser vàlid el document, és necessari garantir la identitat de l'atorgant, així com la seva capacitat, que coneix el seu contingut i que aquest es correspon amb la seva voluntat. Per tal de garantir aquests requisits de validesa, el document s'ha d'atorgar davant d'un notari o amb intervenció de tres testimonis.

This is what I was about to write when I read this:
"pot ser el recull d'una sèrie d'instruccions a tenir en compte (és l'anomenat testament vital) OR......."
you can appoint a representative. Not sure whether this representative is provided for in an "English" living will - I suppose it varies from one person/place to another.
Would think "living will" alone suffices.

While a Health Care Power of Attorney can include written instructions for your patient advocate to follow, the choices do not have to be included for the Health Care Power of Attorney to be used. If a Living Will also includes your choice as patient advocate, it automatically becomes a Health Care Power of Attorney and must follow the state law requirements for witnesses, required language, etc. Since a Health Care Power of Attorney form is widely available, and is enforceable by Michigan statute, it is the smartest choice if you are concerned about these issues.
